What does a credit intermediary do?

A Credit Intermediary is a natural or legal person authorized and registered with the Bank of Portugal to support consumers in the analysis, selection, and contracting of credit. Their mission is to present, propose, explain, and monitor credit solutions, acting as a link between the client and financial institutions, ensuring informed decisions tailored to each consumer's profile.

This activity is regulated by Decree-Law No. 81-C/2017, of July 7, which establishes the legal framework for credit intermediation and the provision of consulting services. This decree defines the requirements for access, suitability, mandatory training, civil liability insurance, information duties, and rules of conduct. The regime was subsequently adjusted by Decree-Law No. 122/2018, of December 28, reinforcing consumer protection and the transparency of the process.

The regulation is complemented by Bank of Portugal Notice No. 6/2017, which details the authorization process, registration, remuneration policies and organizational requirements, and by Instruction No. 16/2017, which defines the forms and documents required for registration applications. Decrees Nos. 385-B/2017, 385-D/2017 and 385-E/2017 regulate mandatory training, certification of training entities and professional insurance.

In the exercise of their functions, Credit Intermediaries may present or propose credit agreements, provide assistance in the preparatory acts of agreements they have not proposed and, when authorized, enter into agreements on behalf of lending institutions. However, they may not grant credit directly or market banking products such as deposits or payment services.

One of the essential principles defined by the Bank of Portugal is that the consumer does not bear any cost for the services provided by the Credit Intermediary. Compensation is guaranteed exclusively by the financial institutions with which the intermediary collaborates, ensuring complete transparency and protection for the client.

This robust legal framework ensures that the consumer is assisted by qualified, trained, and supervised professionals, promoting rigor, trust, and security at all stages of the credit contracting process.

Under Article 46 of the legal framework for credit intermediaries, the receipt and delivery of funds is prohibited, as set out below:

"Prohibition on receipt and delivery of funds
1 – Credit intermediaries are prohibited from receiving or delivering any amounts related to the formation, execution, and early compliance of credit agreements.
2 – The following situations are not covered by the prohibition in the previous number:
a) The receipt of funds by credit intermediaries as remuneration for services provided in Article 4, under Articles 58 and 61;
b) The receipt, by credit intermediaries as an ancillary activity, of funds delivered by lenders for payment of the price of goods or services financed through the credit agreement;
c) The delivery to lenders of funds corresponding to interest and charges associated with a credit agreement, when that agreement is intended to finance the acquisition of goods or services marketed by the credit intermediary as an ancillary activity and the intermediary has assumed payment of such interest and charges to the lender."
